Email to Cllr Rai and Claire Hamilton

I asked Cllr Rai, the Leader of Redbridge Council and Claire Hamilton, Chief Executive for a reply by the 12th June 2026 to the email copied below, no substantive reply has come back, just a holding acknowledgment

Subject: Misconduct in public office allegation: Reply requested by 5pm on Friday 12th June
 

Dear Both

 

My allegation to the police about alleged misconduct in public office concerning Jas Athwal and others has been mentioned in an email/s relating to the lower tribunal appeal. I have chased this up with the police as to whether the there will be investigation in due course, but as yet I have not had any reply.

Your data team sent an email on 30.04.26 following an ICO disclosure order to say the following: 

1) How many notices were issued to selective licence landlords for the period 1st July 2024 to 1st December 2024 including their dates of issue. 

107 notices were issued to 29 landlords/agents relating to 47 properties.” ENDS EXTRACT


I have looked at the index and the bundle, over 500 pages, supplied to me following the ICO order looking for the 16 Notice of Entry forms dated around late August 2024 before the 2nd September 2026 inspection visits to Mr Athwal's rental properties per the schedule below:

I cannot find 16 notices of the same date around that time. I am minded to bring this point to the police as it suggests normal procedure may not not been followed. If normal procedure has been breached regarding notices, it would beg the question of whether normal procedure has been breached elsewhere when it comes to Redbridge Council dealing with Mr Athwal.

 

I also wish to draw to your attention ICO decision notice IC-393085-Y9C9 which contains the following:

 

. The Commissioner’s decision is that the Council has failed to demonstrate that it has carried out adequate searches for the requested information in order to determine whether any information is held and, during the course of the investigation, appears to have advised that further information is held. Therefore, on the balance of probabilities, the Commissioner considers the Council does hold further information falling within the scope of the request. 3. Furthermore, the Commissioner has found that the Council’s handling of the request breached regulation 5(2) of the EIR. 4. The Commissioner requires the Council to take the following steps to ensure compliance with the legislation. • Conduct a further search of its records and issue a fresh response to the complainant, disclosing any information held. In respect of any such information which is exempt from disclosure and the Council wishes to withhold, issue an appropriate refusal notice under the EIR.

 

Therefore, I would be grateful if you would agree to a further search of your records to see if any notice of entry were sent to Mr Athwal which are not in the bundle sent to me.

 

If you are not willing to agree to my request for a further search by 5pm on Friday 12th June, I will be minded to draw this issue to the attention of the  police as a point that needs investigation as part of any investigation they might instigate. If you do not conduct a search or provide a reason for why one is not required, I expect to raise this issue at the lower tribunal hearing later this year.
